K–12 IT Visionary Contest
No purchase necessary. A purchase or payment of any kind will not increase
your chances of winning.
Eligibility:FutureReady Contest: K–12 IT Visionary Contest (the “Contest”) is
open only to public and private elementary and secondary schools with shipping
addresses in the fifty (50) United States and the District of Columbia. Home
schools are not eligible. Individuals submitting an entry on behalf of their
school must be eighteen (18) years of age or older, a U.S. citizen and a legal
resident of the fifty (50) United States (includes the District of Columbia),
and either a full or part-time teacher, administrator, or support staff.
Employees of Dell Marketing, L.P., Microsoft Corporation, ePrize, LLC, Tocquigny,
Inc., and their parent and affiliate companies, promotional/contest agencies,
sales representatives, retailers, distributors, and vendors and their immediate
family (spouse, parents, siblings and children) and household members are not
eligible to participate in any capacity. Subject to all applicable federal,
state, and local laws and regulations. Void where prohibited. Participation
constitutes entrant´s full and unconditional agreement to these Official Rules
and Sponsors and Administrator´s decisions, which are final and binding in all
matters related to the Contest. Winning a prize is contingent upon fulfilling
all requirements set forth herein.

Timing: The Contest begins on September 15, 2005 at 12:00 a.m. Central Time
(“CT”) and ends on November 15, 2005 at 11:59 p.m. CT (the “Contest Period”).
Tocquigny, Inc.´s computers are the official time keeping device for the
Contest.
How to Enter:During the Contest Period, visit www.futureready.org and follow the
links and instructions for entry. Write and submit an essay of no longer than
two thousand (2,000) words, and a summary of the essay no longer than five
hundred (500) words, describing a vision for utilizing technology in education.
Entries must not be inappropriate, indecent or obscene, as determined by
Sponsors in their sole discretion. Proof of submission or sending is not proof
of receipt by Sponsors. All submissions become the exclusive property of
Sponsors, and none will be acknowledged or returned. Sponsors shall have the
perpetual right to edit, adapt, and publish any or all of the essays and/or
summaries submitted in whole or in part, and may use them in any media now known
or late developed without attribution or compensation to the contestant, author,
his or her successors or assigns, or any other entity. Submission of an entry in
this contest constitutes entrant´s and author´s irrevocable assignment,
conveyance, and transference to sponsors of all right, title, and interest in
the entry, including, without limitation, all copyrights. Sponsors are not
responsible for lost, late, incomplete, invalid, unintelligible, illegible, or
misdirected requests, which are void. In addition, by entering, contestants
represent and warrant that the entries that they submit:
Are their own original creations;
Do not infringe any other person´s or entity´s rights; and
Have not been submitted previously in a contest of any kind.
Limit: One (1) Contest entry per person during the Contest Period.
Judging Criteria and Winner Selection: Entries will be divided into categories
corresponding to the number of students enrolled in the school on whose behalf
the essays are submitted. The school size categories are: small (fewer than 500
students), medium (500 to 1500 students), and large (more than 1500 students) as
shown in Market Data Retrievable (“MDR”) database on April 2005 as updated
through September 15, 2005. Winning entries will be chosen based on the
following criteria: (20%) Technological Innovation in Education, (20%) 21st
Century Skill Development, (20%) Enhanced Teacher Productivity and Instruction,
(20%) Using Data-Driven Decision Making to Increase Effectiveness of School
Administration, and (20%) Community Involvement. Qualified judges, whose
decisions regarding the contest and related matters are final, will choose the
contest winners. Judge´s decisions will be subjective and not subject to ties.
Winning schools will be notified by phone or mail on or about January 31, 2006.
Entrants must comply with all contest rules as published. Authorized
representatives from winning schools will be required to sign and return an
Affidavit of Eligibility and Liability and Publicity Release, where permitted,
within fifteen (15) days from the date on the prize notification. Winning
schools agree to conduct any and all media interviews related to the contest if
requested and not disparage the Sponsors during interviews. Failure to comply
with this requirement for any reason or return of prize notification or prize as
undeliverable will result in forfeiture of prize and an alternate winning school
will be selected by the judges from the remaining eligible entries and award the
prize. Acceptance of any prize shall constitute and signify the winning school´s
agreement and consent that Sponsors may use the winning school´s name, address
(city, state), likeness, and/or prize information for contextual purposes
worldwide, including the internet, without limitation and without further
payment or consideration, except where prohibited by law.
Prizes:Three schools will each win a K–12 IT Visionary Prize Package. Prizes
will be structured based on the winning essay entry and a needs assessment
conducted by Dell service professionals. Prize package will consist of client
and enterprise computer hardware and software products offered for sale by Dell
and Microsoft with an approximate retail value of $250,000. Final prize package
is determined by Sponsors in their sole discretion. For all prizes: Winning
schools are responsible for all taxes on prizes. No cash equivalent and all
prizes are non-transferable and no substitution will be made except as provided
herein at the Sponsor´s sole discretion. Sponsors reserve the right to
substitute any listed prize for one of equal or greater value if a designated
prize should become unavailable for any reason.
Microsoft intends that the use of its products awarded as part of this
sweepstakes comply with applicable federal, state, and local government gift and
ethics rules. If you are a government employee (including an employee of a
public education institution), Microsoft products may be used solely for the
benefit of your agency/institution, and not for the personal use or benefit of
any individual. You should consult with your agency/institution counsel or
ethics officer prior to entering the sweepstakes and using such products. You
may return Microsoft products to Microsoft at its expense.
General Conditions:By entering or participating in the Contest, participants
agree to be bound by these Official Rules. Sponsors assume no responsibility for
electronic hardware, programming or software malfunctions, or failures, or line
connections, accessibility or availability, or technical failures of any kind,
or unauthorized human intervention, or the incorrect or inaccurate capture of
any entry or other information, or for the failure to capture any such
information. Sponsors are not responsible for: (1) any incorrect or inaccurate
information, whether caused by entrants, or by any of the equipment or
programming associated with or utilized in the Contest; (2) technical failures
of any kind, including, but not limited to malfunctions, interruptions, or
disconnections in phone lines or network hardware or software; (3) unauthorized
human intervention in any part of the entry process or the Contest; or (4)
technical or human error which may occur in the administration of the Contest or
the processing of entries. Further, if, for any reason, the Contest is not
capable of running as planned by reason of infection by virus, bugs, worms,
tampering, unauthorized intervention, fraud, technical failures, or any other
causes which, in the sole opinion of the Sponsors, may corrupt or affect the
administration, security, fairness, integrity or proper conduct of this Contest,
Sponsors reserve the right, at their sole discretion, to cancel, terminate,
modify or suspend the Contest, and select the winning school for the Contest,
from the entries received prior to the action taken or in other such manner as
deemed fair and appropriate by Sponsors.
Release and Limitation of Liability:Participants, by participating in this
Contest, hereby waive and release, and agree to hold harmless the Sponsors,
Tocquigny, Inc., ePrize, LLC, parent and affiliate companies,
promotional/contest agencies, sales representatives, retailers, distributors,
and vendors and all of their respective officers, directors, employees,
representatives and agents, from and against, any and all rights, claims and
causes of action whatsoever that they may have, or which may arise, against any
of them for any liability for any matter, cause or thing whatsoever, including
but not limited to any injury, loss, damage, whether direct, compensatory,
incidental or consequential, to person, including death and property, arising in
whole or in part, directly or indirectly, from their acceptance, possession, use
or misuse of the prize in the Contest, or their participation in the Contest, or
their participation in any Contest or prize related activity. Winning schools
also further acknowledges that Sponsors, Tocquigny, Inc., ePrize, LLC, parent
and affiliate companies, promotional/contest agencies, sales representatives,
retailers, distributors, and vendors and all of their respective officers,
directors, employees, representatives and agents have neither made, nor are in
any manner responsible or liable for, any warranty, representation or guarantee,
expressed or implied, in fact or in law relative to any prize or these Contest
including but not limited to quality, condition or fitness for a particular
purpose.
Disputes:Except where prohibited, entrant agrees that: (1) any and all disputes,
claims and causes of action arising out of or connected with this Contest or any
prize awarded shall be resolved individually, without resort to any form of
class action, and exclusively by the United States District Court for the
Eastern District of Michigan (Southern Division) or the appropriate Michigan
State Court located in Oakland County, Michigan U.S.A.; (2) any and all claims,
judgments and awards shall be limited to actual out-of-pocket costs incurred,
including costs associated with entering this Contest, but in no event
attorney´s fees; and (3) under no circumstances will entrant be permitted to
obtain awards for, and entrant hereby waives all rights to claim, indirect,
punitive, incidental and consequential damages and any other damages, other than
for actual out-of-pocket expenses, and any and all rights to have damages
multiplied or otherwise increased. All issues and questions concerning the
construction, validity, interpretation and enforceability of these Official
Rules, or the rights and obligations of the entrant and Sponsors in connection
with the Contest, shall be governed by, and construed in accordance with, the
laws of the State of Michigan, U.S.A. without giving effect to any choice of law
or conflict of law rules (whether of the State of Michigan or any other
jurisdiction), which would cause the application of the laws of any jurisdiction
other than the State of Michigan.
